Next week, on December 7, the EB5 Regional Center Program is up for reauthorization. If reauthorized, the EB5 Program would be part of the congressional funding bill for FY 2019.
Although immigration is the hot topic on everyone’s mind, it’s unlikely that the December EB5 deadline for the Regional Center Program will be a priority. What has been continually prioritized is funding for the US-Mexico border wall. President Trump has even threatened government shutdown if the wall is not funded in the next bill.
The EB5 industry expects the program to be extended until September 2019, so why invest now? Although it’s possible that the EB5 Regional Center Program will see an extension without reform, there still exists the possibility of these changes occurring:
- Increase in the minimum investment amount
- Elimination to the per-country visa caps
- More stringent requirements to targeted employment area designations
